Hyperliquid functions as an offshore platform where market participants trade leveraged perpetual futures—derivative contracts without expiration dates—by connecting digital wallets directly without opening standard brokerage accounts. U.S. residents are legally prohibited from accessing the platform. The design bypasses traditional central intermediaries mandated by U.S. derivatives laws, which has historically kept non-custodial crypto platforms offshore under registration and oversight rules. The CFTC has laid step-by-step groundwork toward onshoring, clearing Coinbase Derivatives for perpetual-style Bitcoin and Ethereum futures in April 2025 before granting Kalshi approval for a related offering.

Because perpetuals utilize periodic funding rate payments between long and short traders to track spot pricing rather than settling on fixed dates, federal regulators under the Commodity Exchange Act have treated them as swap products subject to strict financial intermediary registration, capital requirements, and customer protection mandates.
The remainder of the meeting centered on Capitol Hill strategy. Trump urged senators to pass an adjusted version of the Clarity Act—legislative framework establishing distinct SEC and CFTC jurisdictions over digital assets—framing the measure as vital to maintaining competitive advantage over China. The bill returns to the Senate floor in September following recess, where Republicans must secure approximately six Democratic votes to reach the 60-vote threshold.
The administrative push creates a stark dynamic: days after the SEC proposed its initial formal crypto rules, executive leadership publicly directed the CFTC to clear a regulatory path for the sector’s largest offshore perpetual exchange. As the Clarity Act remains pending, regulatory agencies are moving forward independently, pressuring lawmakers to enact legislation or allow regulators to dictate market rules without statutory changes.
