Defense Attorney Held in Contempt in Madison Brooks Case

Judge penalizes defense counsel for failing to redact the LSU student's full name from court filings

A Baton Rouge judge found defense attorney Caitlin Fowlkes in contempt of court Monday for exposing the full name of a sexual assault victim in a public filing, a violation of Louisiana’s strict privacy statutes. The ruling disrupts pretrial proceedings for Desmond Carter, one of four men charged in connection with the 2023 death of 19-year-old Louisiana State University student Madison Brooks.

Fowlkes, who represents the 21-year-old Carter, attached a July motion to a court filing without redacting Brooks’ full name, according to court records. Under Louisiana law, attorneys handling sex crime cases are required to identify victims solely by their initials in all court documents. Judge Gail Horne Ray ruled that despite widespread media coverage and public discussion of the case by state officials, including the governor, “the law is clear that an attorney’s failure to comply with the provisions of this law ‘shall be punishable as contempt of court.'” Fowlkes received no additional punishment beyond the contempt finding.

The procedural penalty stems from a broader defense strategy that has drawn scrutiny from victim advocates. In July, Fowlkes filed a motion attempting to prohibit trial spectators from wearing pink clothing inside the courtroom. Supporters of Brooks have adopted the color as a symbol of solidarity. Judge Ray denied that request in August, ruling that attendees could continue wearing pink during the trial, according to Fox News Digital.

Louisiana maintains some of the most rigid victim-anonymity requirements in the country for sexual offense prosecutions. The mandate applies uniformly, regardless of whether a victim’s identity is already known to the public or widely reported by news organizations. Defense attorneys who fail to redact names face automatic judicial review. While judges possess discretion over the severity of sanctions, the underlying contempt finding is statutory rather than discretionary.

Carter was 17 when authorities took him into custody following the Jan. 15, 2023, incident. According to officials, Brooks left Reggie’s Bar in the Tigerland entertainment district near the LSU campus with Carter, Casen Carver, Kaivon Washington, and Everett Lee. A coroner’s report later determined Brooks had a blood alcohol concentration of .319 at the time of her death and sustained injuries consistent with rape, according to Fox News Digital.

Prosecutors allege Carver drove the group to a parking lot where Carter and Washington sexually assaulted Brooks. The men told investigators she subsequently asked to be taken home, providing several incorrect addresses before requesting to be dropped off near a residential subdivision. They stated she then walked into traffic and was struck by a vehicle. The driver remained at the scene and was cleared of criminal charges.

Brooks’ mother, Ashley Baustert, previously told Fox News Digital that her daughter believed she was with trusted acquaintances that night. “Maddie felt safe that night, she thought these were her friends and I think a lot of selfish choices were made that night, and ultimately it led in a horrific ending,” Baustert said.
