SpaceXAI Outlines Yearlong Schedule to Decommission Unpermitted Gas Turbines Near Memphis

The company faces a Clean Air Act lawsuit while building a 1.2GW replacement power plant.

SpaceXAI has established a yearlong timeline to fully dismantle 69 unpermitted gas turbines generating power for its data center facilities near Memphis, Tennessee.

The phase-out will begin in August 2026 and run through July 2027 under an agreed order with the Mississippi Department of Environmental Quality. Power generation will transition to a newly permitted 1.2-gigawatt power plant currently under construction in Mississippi.

The regulatory action comes amid a legal challenge brought in April by the NAACP, which alleged that the unauthorized operation of dozens of combustion units violated federal air standards and exposed neighboring communities to hazardous emissions linked to asthma, heart failure, and cancer.

The dispute underscores growing tension between the rapid expansion of artificial intelligence infrastructure and local environmental governance. High-performance data center operations require immense electricity loads, driving tech firms toward rapid onsite power generation while awaiting utility grid upgrades. Under the federal Clean Air Act, large stationary sources of industrial pollution must complete rigorous pre-construction permitting to ensure regional air quality standards are preserved.

SpaceXAI maintains that environmental testing indicates ambient air monitoring around its operations continues to meet or exceed EPA safety benchmarks. A motion filed by the Department of Justice in June seeking to dismiss the civil rights suit has not halted court proceedings.

Since SpaceX acquired xAI in February 2026, the company has continued expanding its commercial compute footprint, securing data center capacity agreements with major artificial intelligence developers including Google and Anthropic.
