Trump Cabinet Members to Launch Official TikTok Accounts Following DOJ Legal Clearance
A newly disclosed Justice Department opinion paves the way for federal officials to use the restructured platform, marking a major policy shift.
Members of President Donald Trump’s Cabinet are preparing to establish official presences on TikTok, marking a significant reversal in the federal government’s approach to the controversial social media platform.
The coordinated rollout follows a newly disclosed legal opinion from the U.S. Department of Justice Office of Legal Counsel. The memorandum, dated July 16, concludes that federal personnel are legally permitted to use the application because its current domestic operations have transitioned to a U.S.-approved corporate structure that exempts it from the existing federal government ban.
According to the Justice Department, the version of the platform managed by the TikTok U.S. Data Security Joint Venture does not violate the No TikTok on Government Devices Act. Passed by Congress in 2022, that statute prohibited the application on federal government-issued devices due to national security apprehensions surrounding its Beijing-based parent firm, ByteDance.
The original legislative restriction specifically targeted iterations of the software developed or distributed by entities where ByteDance retains a controlling stake. However, federal legal analysts determined that the newly established joint venture operates independently of the Chinese parent company. The restructured entity is majority-owned by American investors and has overhauled both its cybersecurity protocols and its proprietary content recommendation algorithm to prevent foreign access to sensitive federal information.
This policy pivot represents a stark contrast to the bipartisan efforts over several years to restrict or outright ban the application in the United States. During his first term in office, Trump had attempted to block the platform via executive order, citing data privacy and espionage concerns.
In his subsequent political campaigns, however, Trump increasingly utilized the platform to engage with younger demographics. He has frequently credited his presence on the application with bolstering his digital reach during the 2024 presidential race, pointing to high viewership metrics as evidence of its political utility.
While some national security analysts and lawmakers continue to voice skepticism regarding the efficacy of the corporate restructuring, the Justice Department’s administrative clearance effectively clears the path for executive branch agencies to integrate the platform into their public communication strategies.
