{"id":17418,"date":"2026-08-17T22:20:36","date_gmt":"2026-08-17T22:20:36","guid":{"rendered":"https:\/\/nile1.com\/en\/?p=17418"},"modified":"2026-08-17T22:20:46","modified_gmt":"2026-08-17T22:20:46","slug":"minnesota-defends-landmark-ai-deepfake-law-against-xai-legal-challenge","status":"publish","type":"post","link":"https:\/\/nile1.com\/en\/2026\/08\/17\/minnesota-defends-landmark-ai-deepfake-law-against-xai-legal-challenge\/","title":{"rendered":"Minnesota Defends Landmark AI Deepfake Law Against xAI Legal Challenge"},"content":{"rendered":"<p>Minnesota Attorney General <a href=\"https:\/\/nile1.com\/en\/2026\/07\/28\/federal-court-blocks-minnesota-law-criminalizing-prediction-markets-days-before-effective-date\/\" class=\"auto-internal-link\" title=\"Federal Court Blocks Minnesota Law Criminalizing Prediction Markets Days Before Effective Date\">Keith Ellison<\/a> is asking a federal court to preserve state law HF-1606, defending the landmark ban on AI-generated sexual images against a constitutional lawsuit brought by Elon Musk\u2019s <a href=\"https:\/\/nile1.com\/en\/2026\/07\/31\/coinbase-posts-unexpected-359-million-q2-loss-as-spot-trading-activity-drops\/\" class=\"auto-internal-link\" title=\"Coinbase Posts Unexpected $359 Million Q2 Loss as Spot Trading Activity Drops\">xAI<\/a>.<\/p>\n<p>In legal documents submitted Friday, Ellison asserted that xAI cannot demonstrate that the law&#8217;s enforcement will inflict irreparable harm, maintaining that the firm&#8217;s First Amendment claims are bound to fail.<\/p>\n<p>\u201cWith Grok Imagine, X.AI has created an unparalleled marketplace for digital sexual violence that poses virtually no barrier to entry,\u201d Ellison wrote. \u201cThat marketplace, coupled with the functional capabilities of Grok Imagine, would doom Minnesota from the start if it could not direct its laws to the technology that makes digital sexual victimization possible in the first place.\u201d<\/p>\n<p>Passed in April before going into effect August 1, the statute bars software creators and digital platforms from permitting users to manufacture lifelike images displaying intimate body parts absent from an identifiable person&#8217;s original photo.<\/p>\n<p>While standard criminal laws traditionally focus on individual users who distribute explicit material, Minnesota\u2019s HF-1606 expands regulatory reach by holding developers and platform operators directly responsible for providing tools that facilitate non-consensual image creation.<\/p>\n<p>Seeking to halt the statute prior to its rollout, xAI filed a lawsuit against Ellison in July, contending that HF-1606 infringes upon First Amendment protections and could ensnare non-explicit content like political satire, swimmers, or shirtless men, while exposing developers to fines reaching $500,000 per image.<\/p>\n<p>&#8220;There is no safe harbor for good-faith efforts of the provider of general-purpose AI creative tools to avoid harms,&#8221;
