Minnesota Attorney General Keith Ellison<\/a> is asking a federal court to preserve state law HF-1606, defending the landmark ban on AI-generated sexual images against a constitutional lawsuit brought by Elon Musk\u2019s xAI<\/a>.<\/p>\n

In legal documents submitted Friday, Ellison asserted that xAI cannot demonstrate that the law’s enforcement will inflict irreparable harm, maintaining that the firm’s First Amendment claims are bound to fail.<\/p>\n

\u201cWith Grok Imagine, X.AI has created an unparalleled marketplace for digital sexual violence that poses virtually no barrier to entry,\u201d Ellison wrote. \u201cThat marketplace, coupled with the functional capabilities of Grok Imagine, would doom Minnesota from the start if it could not direct its laws to the technology that makes digital sexual victimization possible in the first place.\u201d<\/p>\n

Passed in April before going into effect August 1, the statute bars software creators and digital platforms from permitting users to manufacture lifelike images displaying intimate body parts absent from an identifiable person’s original photo.<\/p>\n

While standard criminal laws traditionally focus on individual users who distribute explicit material, Minnesota\u2019s HF-1606 expands regulatory reach by holding developers and platform operators directly responsible for providing tools that facilitate non-consensual image creation.<\/p>\n

Seeking to halt the statute prior to its rollout, xAI filed a lawsuit against Ellison in July, contending that HF-1606 infringes upon First Amendment protections and could ensnare non-explicit content like political satire, swimmers, or shirtless men, while exposing developers to fines reaching $500,000 per image.<\/p>\n

“There is no safe harbor for good-faith efforts of the provider of general-purpose AI creative tools to avoid harms,” xAI wrote in its complaint. “Liability attaches even if the depicted persons consented\u2014or created the image themselves\u2014and even if the image is never shared.”<\/p>\n

State legislators overwhelmingly approved the bill by votes of 132-1 in the House and 65-0 in the Senate, acting after testimony revealed a man had pulled social media photographs to generate explicit sexual pictures of over 80 women in his community.<\/p>\n

\u201cToday, we led the nation protecting women, children and everyone in public life from the harm caused by AI nudification technology,\u201d Senator Maye Quade, who led the push, said in a statement at the time. \u201cCompanies that make this technology available for free online and in app stores will no longer be allowed to enable predators who abuse and victimize adults and children with the click of a button.\u201d<\/p>\n

The constitutional dispute focuses primarily on whether the law regulates speech or technology.<\/p>\n

Beyond the Minnesota litigation, xAI’s Grok platform has encountered widespread criticism regarding the generation of explicit imagery.<\/p>\n

A watchdog group estimated in January that Grok generated upwards of 23,000 sexualized child images across an 11-day period, triggering official inquiries from international regulators.<\/p>\n

Litigation expanded in March when three California minors joined a lawsuit against xAI, contending the platform transformed their photographs into AI-generated child sexual abuse material, even as xAI disclosed that it disabled over 50,000 accounts and submitted more than 70,000 reports to the National Center for Missing and Exploited Children in 2026.<\/p>\n
