Under the statutory framework, domestic employers must verify that no qualified U.S. workers are available before sponsoring foreign candidates for permanent resident status.<\/p>\n<p>According to federal investigators, OpenAI actively bypassed U.S. workers by intentionally keeping PERM-related job openings off its main employment website. The company also required applicants to submit physical paper resumes by mail instead of accepting digital submissions, and ran recruitment advertisements on late-night radio broadcasts.<\/p>\n<p>&#8220;It is illegal to discriminate against U.S. workers by preferring temporary visa holders for jobs,&#8221; said Assistant Attorney General Harmeet K. Dhillon.<\/p>\n<p>As part of the settlement, OpenAI will pay $1.2 million in civil fines and establish a $2 million fund to compensate U.S. applicants who were passed over. OpenAI denied all allegations of wrongdoing in the settlement agreement.<\/p>\n<p>OpenAI must also overhaul its recruitment guidelines, implement mandatory training on anti-discrimination laws for human resources personnel, and submit to compliance reporting managed by the Justice Department.<\/p>\n<p>The penalty is the 13th settlement secured by federal prosecutors since last year involving corporate discrimination against American job seekers.
