Buc-ee&#8217;s alleges that the local business adopted a smiling rodent graphic and red color scheme that closely mimics its established intellectual property, creating potential consumer confusion.<\/p>\n<p>Buc-ee&#8217;s argues it has held federal trademark protections for its iconic beaver logo for over 40 years and maintained priority trademark rights well before the Ohio store initiated use of its current branding.<\/p>\n<p>The lawsuit comes shortly after Buc-ee&#8217;s expanded its footprint into Ohio, opening a massive travel center near Dayton in April. However, Beaver&#8217;s Mini Mart operates without fuel pumps, is situated miles from the nearest interstate highway, and has been owned by local operator Vik Boparai for over a decade\u2014predating Buc-ee&#8217;s initial expansion outside Texas in 2018.<\/p>\n<p>&#8220;I don&#8217;t know why they would sue a small business like mine,&#8221; Boparai said. &#8220;I have two kids and this store is how I feed them.&#8221;<\/p>\n<p>Local officials in Beavercreek, where the native rodent serves as a widespread municipal symbol and mascot for area businesses and the local high school, pushed back against the travel chain&#8217;s legal filing. Beavercreek Councilman Zach Upton dismissed the claim that shoppers would mistake the single neighborhood shop for a national travel hub.<\/p>\n<p>&#8220;Common sense is not prevailing,&#8221; Upton said. &#8220;I can&#8217;t imagine anyone would be confused by the mini mart and Buc-ee&#8217;s. It&#8217;s not even in the same ballpark.&#8221;<\/p>\n<p>Under U.S. intellectual property law, trademark owners are required to actively enforce their marks against potential infringement to prevent brand dilution or loss of legal rights. However, Buc-ee&#8217;s aggressive enforcement strategy\u2014which includes more than a dozen lawsuits against smaller businesses using animal mascots\u2014has routinely resulted in out-of-court settlements due to the financial imbalance of protracted legal disputes.<\/p>\n<p>The legal action follows heightened national attention surrounding Buc-ee&#8217;s litigation practices. On a July 26 episode of HBO&#8217;s &#8220;Last Week Tonight,&#8221; host John Oliver criticized the company for targeting small retailers with limited legal resources.
