European regulators are extending their most stringent digital governance framework to generative artificial intelligence and interactive gaming platforms. OpenAI<\/a>‘s ChatGPT<\/a> and gaming ecosystem Roblox are slated to be designated as Very Large Online Platforms (VLOPs) by the European Union<\/a> this August, expanding a list previously dominated by major social networks and search engines.<\/p>\n<\/p>\n

Under the provisions of the European Commission<\/a>‘s Digital Services Act framework<\/a>, any platform or search engine that crosses the threshold of 45 million monthly active users within the 27-member trading bloc qualifies for the VLOP status. Once formally listed, both companies will join tech giants already under high-level scrutiny, including Meta\u2019s Facebook and Instagram, ByteDance\u2019s TikTok, Elon Musk\u2019s X, Alphabet\u2019s YouTube, Google Maps, Google Play, Snapchat, and WhatsApp.<\/p>\n

The regulatory classification triggers a strict four-month compliance timeline. Within this grace period, OpenAI and Roblox must overhaul their operational transparency and safety procedures across several key areas. They will be required to establish designated points of contact for European authorities and consumers, deploy easily understandable terms of service, and disclose the internal mechanisms behind their advertising systems, content moderation policies, and recommendation algorithms.<\/p>\n

A core component of the mandate involves proactive risk mitigation. Designated platforms must regularly evaluate structural vulnerabilities related to illegal online content, threats to electoral processes, gender-based violence, discrimination, and potential harm to freedom of expression and media pluralism. To ensure these assessments translate into tangible safeguards, companies must maintain internal compliance teams and submit to annual independent security audits.<\/p>\n

The mandatory obligations also address law enforcement collaboration and research transparency. Designated entities are obligated to share operational data with the European Commission and vetted independent researchers, while maintaining clear protocols to report suspected criminal offenses directly to relevant authorities. Failure to comply with these rules can result in severe financial penalties, reaching up to 6% of a company\u2019s global annual turnover.<\/p>\n

The impending designation comes as both platforms navigate heightened public scrutiny over safety and user protection. Roblox has faced legal actions and investigations regarding child endangerment, with claims alleging the platform failed to prevent adult predators from targeting young users in its virtual spaces.<\/p>\n

OpenAI has similarly drawn criticism regarding safety protocols. The company encountered intense backlash after revealing it had banned an account belonging to the suspect in the 2025 Tumbler Ridge mass shooting without notifying law enforcement prior to the event\u2014a policy it subsequently revised to mandate the reporting of credible safety threats. Additionally, OpenAI faces wrongful death litigation filed by families alleging that ChatGPT lacked adequate guardrails to prevent or intervene in self-harm and suicidal behaviors among vulnerable users.<\/p>\n
